The profession

What is a solicitor (solicitador)?

A legal professional who handles everyday legal matters for individuals and companies. Solicitors hold a university degree, are registered with the Portuguese Order of Solicitors and Enforcement Agents, and can work anywhere in Portugal, not only where they have an office.

What a solicitor can do for you

  • Advise. Explain your rights and options before you decide.
  • Prepare contracts and transactions. Purchases and sales, gifts and estate divisions, with the steps required at registry offices and notaries.
  • Certifications and authentications. Certify signatures, authenticate documents and certify copies.
  • Represent you before the Tax Authority and other public services. Complaints and appeals against administrative and tax decisions.
  • Recover debts. Negotiate and recover what you are owed.
  • Represent you in court. Within the limits set by law.

A protected title

Only people registered with the Order, as shown by their professional licence, may use the title. Registration means verified training, ethical rules and a disciplinary system of its own. Performing acts reserved to lawyers and solicitors without being qualified is a crime.

Professional secrecy

What you tell your solicitor and the documents you hand over are protected by professional secrecy, under the law.

Fees

Fees are set case by case. The Statute of the Order lists criteria such as the importance of the service, the difficulty and urgency of the matter, the time spent, the responsibilities taken on and the result obtained.
